L’AED, en tant qu’autorité de supervision des autres établissements financiers selon les articles 2-1 (8), Ier (3bis) e) et 2 (I) 7 de la loi modifiée du 12 novembre 2004 relative à la lutte contre le blanchiment et financement du terrorisme ("Loi LBC/FT"), a lancé le 1er février 2021 une campagne d’invitation auprès du Responsable du contrôle ("RC") et Responsable du respect ("RR") de tous les FIAR par courriel afin de compléter et transmettre le "Questionnaire FIAR LBC/FT 2020" pour l’exercice comptable se terminant en 2020, conformément à leur obligation de coopération avec les autorités selon l’article 5 de la Loi LBC/FT.
Compte tenu que ce questionnaire doit être transmis de manière annuelle, l’AED invite les FIAR à compléter et transmettre le "Questionnaire FIAR LBC/FT 2022" pour l’exercice comptable se terminant en 2022. Le dernier délai pour le dépôt du "Questionnaire FIAR LBC/FT 2022" est le 31 mai 2023.
A cet effet, l’AED a publié un guide à destination des FIAR les guidant à compléter le questionnaire.
Le "Questionnaire FIAR LBC/FT" doit être transmis par le RR du FIAR à l’AED. Cependant, le RR peut mandater le RC du FIAR pour transmettre ce questionnaire.
Instructions pour transmettre le "Questionnaire FIAR LBC/FT":
1. Télécharger le Questionnaire :
- "FIAR_AML-CFT_QUESTIONNAIRE_2021" pour l’exercice comptable du FIAR se terminant en 2021 ou ;
- "FIAR_AML-CFT_QUESTIONNAIRE_2022" pour l’exercice comptable du FIAR se terminant en 2022.
2. Le questionnaire rempli doit être transmis sous son format original Excel à l’AED à l’adresse électronique suivante:
Tout autre format de transmission, par exemple une version .pdf du questionnaire ne sera pas accepté.
3. Format du nom du fichier Excel à transmettre :

The Registration Duty, Estate and VAT Authority (“AED”), as the supervisory authority of the other financial institutions (autres établissements financiers) according to the articles 2-1 (8), 1 (3a) e) and 2 (1) 7 of the Law of 12 November 2004 on the fight against money laundering and financing of terrorism, as amended (“AML/CFT Law”), has launched a campaign to invite the AML/CFT compliance officer (Responsable du contrôle) (“RC”) and the person responsible for compliance with the professional obligations as regards the fight against money laundering and terrorist financing (Responsable du respect) (“RR”) of all RAIFs on 1st February 2021 by email to fill in and transmit the “RAIF AML/CFT Questionnaire 2020” for the financial year ending in 2020, pursuant to their obligation to cooperate with the authorities in accordance with article 5 of the AML/CFT Law.
Given that the questionnaire must be transmitted on a yearly basis, the AED invites the RAIFs to fill in and transmit the “RAIF AML/CFT Questionnaire 2022” for the financial year ending in 2022. The deadline for the submission of the “RAIF AML/CFT Questionnaire 2022” is 31 May 2023 CoB.
In this context, the AED has published a guide for the RAIFs guiding them to complete the questionnaire.
The “RAIF AML/CFT Questionnaire” must be transmitted by the RR of the RAIF to the AED. Nevertheless, the RR can mandate the RC to transmit the questionnaire.
Instructions to transmit the “RAIF AML/CFT Questionnaire”:
1. Download the questionnaire:
- “FIAR_AML-CFT_QUESTIONNAIRE_2021” for the financial year ending in 2021 or;
- “FIAR_AML-CFT_QUESTIONNAIRE_2022” for the financial year ending in 2022.
2. The completed questionnaire should be returned under its Excel original format to the AED to the following email address:
Any other transmission format, e.g. a .pdf version of the form will not be accepted.
3. Format of the name of the Excel file to be transmitted:
- Please respect the following name format:
